Terms of Service

These Terms of Service ("Terms") govern your use of the website dawncrestconsulting.com, the AI Exposure Index assessment, and the paid plans offered by Dawncrest Consulting LLC ("Dawncrest," "we," "us," or "our"). By using the site or purchasing a plan, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Dawncrest provides a free AI Exposure Index assessment and paid, AI-generated career planning content, including weekly action plans, a 52-week roadmap, and career pivot analyses. Scores and plans are generated from your assessment responses using a scoring model and AI language models.

The service is informational only. Scores are estimates produced by a weighted scoring model — not predictions, probabilities, or guarantees about your job or industry. Plans are AI-generated suggestions, not professional career, financial, or legal advice. You are responsible for your own career decisions, and we recommend consulting qualified professionals before making significant ones.

2. Accounts

• You must be at least 16 years old to use the service and at least 18 (or the age of majority where you live) to purchase a plan.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• You agree to provide accurate information when creating an account or taking the assessment.

3. Plans, Billing, and Renewal

• This Week Plan ($9.99): a one-time purchase. No subscription and no recurring charges.
• 52-Week Roadmap ($7.99/week) and Career Pivot Engine ($12.99/week): weekly subscriptions that renew automatically every week until you cancel. Roadmap content unlocks progressively, one week at a time, while your subscription is active.

All payments are processed by Stripe. Prices are in U.S. dollars and may change; we will give notice of price changes before they apply to an existing subscription. Taxes may apply depending on your location.

4. Cancellation and Refunds

• You can cancel a subscription at any time from your account settings via the billing portal.
• Cancellation takes effect at the end of your current weekly billing period. You keep access to your paid content until then, and you will not be charged again.
• Because paid content is delivered digitally and immediately, payments already made are non-refundable, including partial billing periods — except where a refund is required by law or the service materially failed to deliver what you purchased. • If you resubscribe after cancelling, your existing plans and progress are restored.

5. AI-Generated Content

Plans and analyses are generated by AI language models based on your assessment responses. AI-generated content can contain errors, omissions, or recommendations that do not fit your circumstances. We do not guarantee the accuracy, completeness, or usefulness of any plan, score, or recommendation, and we do not guarantee any outcome — including job retention, career transition, or income — from following them.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms.
• Attempt to probe, disrupt, or gain unauthorized access to the service or other users' data.
• Scrape, resell, or redistribute the service or its content without our written permission.
• Submit assessments or trigger plan generation through automated means.

7. Intellectual Property

The service, including its scoring model, design, and content, is owned by Dawncrest Consulting LLC. Plans generated for you are yours to use for personal, non-commercial purposes. You may share your score page; you may not resell or republish paid plan content.

8. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) survive.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that scores or plans will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, Dawncrest Consulting LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of income, employment, opportunities, or data, arising from your use of the service. Our total liability for any claim arising out of these Terms or the service is limited to the amounts you paid us in the twelve (12) months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Nothing in these Terms limits consumer rights you may have under the laws of your place of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will post changes on this page with an updated "Last updated" date, and for material changes affecting active subscriptions we will provide notice by email or on the site. Continued use of the service after changes take effect constitutes acceptance.
